Background

 

The Smart Growth District Zoning Initiative stems from the comprehensive Master Plan which was adopted by the Planning Board in 2004.  The Master Plan identified the Lower Washington Street Industrial Zone as an area which provides great potential for redevelopment.  Following adoption of the Master Plan, Mayor Dolan created the Smart Growth Task Force to study this area for potential zoning changes. 

 

The Smart Growth Task Force is comprised of community members with a long history of involvement in planning and land use issues and includes representation from the Planning Board , the Zoning Board of Appeals, the Master Plan Committee and the Board of Aldermen .  With technical assistance provided by the Office of Planning and Community Development and a planning consultant retained with grant funds for this purpose, the Smart Growth Task Force identified a vision for how the Lower Washington Street Industrial District should be redeveloped.  As part of the process, the Task Force held a neighborhood meeting to learn what local residents desired to see in the area.  This meeting confirmed that the Task Force and neighborhood residents share a common vision—a mix of residential and commercial/office uses, which are built on a pedestrian scale, take advantage of the close proximity to mass transit and minimize negative impacts on the neighborhood and the City at large. 

 

For the past year, the Task Force has been working to draft a zoning amendment that promotes this vision.  OPCD received additional grant funding from the Commonwealth to help write the ordinance and review potential impacts of the proposed rezoning on the City.  This past December, the Task Force held another neighborhood meeting to receive feedback on the draft zoning proposal.  The draft was favorably received and forwarded to the full Planning Board for review.  The Board reviewed the document and voted unanimously to submit the proposed amendment to the Board of Aldermen for passage.

Amendment Process

 

The process for amending the zoning ordinance is dictated by Massachusetts General Laws Chapter 40A, Section 5.  According to these regulations once the Board of Aldermen receives a proposal for a zoning amendment, the Board must, within fourteen days of receipt, submit the amendment to the Planning Board for review.  The Board of Aldermen and Planning Board must then hold a public hearing within 65 days.  The public hearing for this zoning initiative has been scheduled for March 10, 2008 .  After the public hearing the Planning Board has twenty-one days to submit a report to the Board of Aldermen on the proposed amendment.  The Board of Aldermen will take action of the ordinance upon receipt of the report or after 21 days has elapsed.  A two-third majority vote is needed to adopt the zoning amendment.

 

Fiscal Impact Analysis

 A fiscal impact analysis was prepared to obtain an understanding of how the Smart Growth District Zoning Amendment (i.e. allowing residential and commercial mixed uses in the Lower Washington Industrial District) would affect the City financially.  The analysis, prepared by Connery Associates, was funded by Stoneplace LP, a contract purchaser of a tract of property on lower Washington Street in Melrose.  With grant funding from the State, the City retained a consultant to review the fiscal analysis to ensure accuracy in the methodology and conclusions.    Attached is the final analysis, which incorporates feedback from the City funded peer reviewer. 

 

Infrastructure Report

With grant funding from the State, the City retained Earth Tech, an engineering consultant group, to review the potential impact that the Smart Growth District Zoning Amendment would have on the City’s infrastructure.  Specifically, the report discusses the capacity of the existing water, sewerage, and stormwater systems to determine what, if any, mitigation would be required in order to effectively service new development in the Lower Washington Street Industrial District without negatively impacting the surrounding area.

A Traffic study was conducted to determine the effect the Smart Growth District Zoning Amendment would have on the traffic circulation, flow and safety in the Lower Washington Street Industrial District and the surrounding area.  The report, prepared by McMahon Transportation Engineers and Planners, was funded by Stoneplace LP, a contract purchaser of a tract of property on lower Washington Street in Melrose .  The City, with funds from a State awarded grant, retained Earth Tech to review the accuracy of the report’s methodology and conclusions.

The other component of this zoning proposal involves amending existing Site Plan Review provisions in the Ordinance.  Site Plan Review has become a very important tool, allowing the Planning Board to guide development to be compatible with the character of existing development in Melrose and to limit the negative impacts of new development on the community.  With the experience of several Site Plan Review applications behind us, the Planning Board has come to recognize that the criteria by which the Planning Board reviews Site Plans do not adequately address certain issues and at times is too broad to have a clear meaning. 

 

Because the Smart Growth District Zoning Amendment allows residential and mixed-use development under a Site Plan Approval Process, the Planning Board feels that it is appropriate to strengthen the Site Plan Review language at this time.  The proposed changes to Site Plan Review are primarily limited to strengthening the review criteria in Section 235-16.1 E.

The Mayor’s Smart Growth Task Force held two neighborhood meetings.  The first was to hear what residents would like to see in the Lower Washington Street Industrial District.  The second meeting was to introduce the draft Smart Growth District Zoning Amendment and receive feedback on the draft.
