LOTS
No rights of burial in any lot in Wyoming Cemetery shall be sold to non-residents of the City of Melrose.

In the event the proprietor or legal representative or anyone listed on the ?Advance Authorization to
Inter ? was a non-resident at the time of death, it is still permissible for such a person to be the first one interred in that lot or grave.

No more than one lot may be sold to any one person. For all lots sold, the first interment must be a Melrose resident.
A second purchase is permissible to a Melrose resident if the first purchased lot is filled.

Residents purchasing new graves or lots must make said purchase in the Cemetery section open for sale at that time. As an example, if a purchase is for a two grave lot, said purchase must be made in the section and row being sold at that particular time (commonly referred to as a working section). NO EXCEPTIONS WILL BE MADE. This ruling is in effect for all lots and graves sold in the Cemetery.

Lots are conveyed by special deed under the Seal of the City of Melrose. They are exempt from taxation, cannot be mortgaged nor seized for debt.

All lots are sold with Perpetual Care and shall be used for no other purpose than a place of burial for human remains.

It is the sole responsibility of the Cemetery staff to bury within it?s grounds. No private contractors may be hired to perform this task.

All interments or other work shall be under the personal charge of the Superintendent and/or his designee.

Suitable corner markers and number will define all lots by the department and it is unlawful for any person to remove or tamper with said markers.

No lot will be deeded to more than one owner nor may a lot be divided. No objection exists to an agreement between families as to the parts of lots to be used by each, but the department will not undertake to record or enforce such agreements.

In case of the death of a Proprietor, it shall be the duty of the heirs or devisees to file with the Cemetery legal proof of ownership. This is very important as the Cemetery cannot allow any work performed in or upon the lot until such time as there is a representative appointed by the heirs with the power of signing orders. (Chapter 114, Sec. 29, General Laws of Massachusetts.) The Law governing inheritance of lots will be found in the back of this booklet.

Upon the death of the representative the heirs should immediately appoint a successor.

No sale, transfer or assignment of any lot shall be valid without the approval of the Cemetery Commissioners.

The record of deeds kept in the Cemetery office is the only evidence of the title of the Proprietor which is recognized by the Cemetery; consequently when a person receives a lot by transfer from the Proprietor he/she should send said deed to the office for recording at once.

Proprietors may erect memorial structures on their lots subject to the regulations set forth under the title MEMORIAL STRUCTURES.

Proprietors may cultivate plants on their lots subject to the approval of the Department, but if such planting becomes neglected or is deemed objectionable or detrimental, the Commissioners reserve the right to remove such planting. If done on lots under Perpetual Care, the owner must bear the expense of putting the ground in proper condition again.

On lots or graves where no monument has been erected, the sod under no condition shall be allowed to be broken.

Lot enclosures of any kind are not permitted.

The Superintendent shall remove from lots and graves flowers or emblems whenever in his opinion, the same have become so withered or decayed as to render their removal desirable. Floral emblems so removed will be put in the common dump and employees shall refuse to attempt to find them after having been so disposed.

The Cemetery Commissioners reserves the right to alter the plots of walks, avenues and unsold areas.

Potted plants, baskets and flowers unless maintained and flourishing will be removed from 5 to 10 days after placement, or as soon as the Cemetery Commissioners deems it necessary.

The Cemetery Department will sell one single grave to the estate of a Melrose resident who has made no previous purchase of land.

Receipts are issued for single graves and said graves are not transferable.

Purchasers of single graves are cautioned to preserve the grave receipt as this is the only means they have of proving their rights to such graves.

Persons wishing to have any work done on a single grave must present the receipt.

Whenever a single grave shall become vacant by the removal of the body therefrom, the land shall revert to the department, but in case the owner thereof becomes the purchaser of a lot in Wyoming Cemetery, the original price paid for the grave will be refunded.

All fees must be paid in advance of work or purchase.

Headstones or markers will be allowed on single graves subject to the regulations as set forth under Memorial Structures.

The flag holder or organization emblem will be designated by the family of the deceased and notification of said decision shall be given to the Superintendent of the Cemetery. It shall be at the discretion of the Superintendent as to the placement of the emblem or flag holder. If bouquet holders are used they must be approved by the department and set in the ground flush, otherwise they may become broken by grass cutting machinery or lost.

PLANTING OF TREES AND SHRUBS

The planting of trees and shrubs is forbidden in all sections of the Cemetery.

Planting urns or permanent flower vases are not permitted within the Cemetery.

The department will use constant care in examining trees, removing such parts thereof as appear to be dangerous or detrimental, but expressly disclaims responsibility for damage to either persons or property resulting from falling trees or parts thereof.

No shrubs or trees are to be planted in the Wyoming Cemetery, except by the Cemetery staff under the supervision of the Commissioners and/or Superintendent.
Non-woody plants such as perennials, bulbs, summer flowers or mums may be planted provided that such plantings conform to the following requirements:
Plants may extend their foliage for a distance of no more than 15? in front of a stone.
Plants may attain a maximum height that is less than ½ the height of the stone for that particular grave (not surrounding graves).
Plants may not be planted or extend beyond the side of the stone monument.
Plants may be planted only in the front facing (vault side) of the monument.
All persons installing plants do so at their own risk and expense.
Fencing, stones and pavers used as borders for graves or plantings are not allowed for use within the Cemetery.
The Cemetery reserves the right to remove any plants or plantings that it deems to be disruptive or non- conforming to the normal operation of the Cemetery.
During normal trimming and mowing operations, damage may occur to plantings. All effort will be made by the staff in using care when working around these plantings. The Cemetery is not responsible for any damage, replacement/s or replacement cost resulting from their actions.
Reasonable efforts by the staff will be made to contact owners of lots or graves before removing shrubs and trees that interfere with the Cemetery operation. If contact with proprietors cannot be made, the Cemetery Department reserves the right to remove those plants from said graves.
