Minutes
1. Voted: To accept the minutes of 6/17/99.
76 Bay State Road/David Fimiani
2. Correspondence was read concerning David Fimiani. Construction is
now going on at Bay State Road concerning the pipe that takes the water
from the wetlands and sends it through the system. A call was made to
the City Hall to ask when the pipe work was done to his neighborhood
could the conservation land (vegetation and bushes) in that area be
cut and cleaned by the city. Mr. Fimiani thinks it would make a nice
park area and if the city is willing to do a one time cleaning, he and
a neighbor are willing to maintain the area. The question was then referred
to the DPW and the comment came back that "State and Federal
law mandates conservation land cannot be cut".
Books Donated to Melrose Public Library
3. Correspondence from the Melrose Public Library Director, Dennis
Kelly, was read, acknowledging the conservation's gift of books titled
"Wetlands: Guide to Science, Law and Technology", "Northern Forested
Wetlands: Ecology and Management" and "Creating Freshwater Wetlands".
A plate will be affixed to each book as a gift of Melrose Conservation
Commission for Project: Wonders of Wetlands.
Granite & Burnett Sts./Plan Change Request
4. Correspondence was read from DEP File #217-103 - Plan Change Request
Response/
Granite & Burnett Sts. The DEP department acknowledged the request
for plan change dated 3/29/99 and states that it involves revised grading
for Lot B to accommodate a driveway and a sewer service off of Burnett
Street. The water line will remain off to Granite Street and the modified
plan provides required compensatory storage and replication of isolated
vegetation. Upon review of the plan and documentation submitted with
the request, it is the DEP's opinion for Special Condition 16 of the
Superceding Order of Conditions (SOC), that the modifications constitute
an insignificant change to the plan, do not require the filing of a
new Notice of Intent (NOI), do not require the amendment to the superceding
Order of Conditions and therefore are permitted under the SOC issued
for this project by the Department on 9/10/97. The following plan reference
shall be substituted for that contained in the SOC; Plan of Land, Granite
& Burnett Sts. Melrose, MA, prepared for Leslie Nash by Otte &
Dwyer, Inc. with engineering by McKenzie Engineering Group, Inc. Sheet
2, dated 6/3/96 and last revised 5/28/99 , signed and stamped by Bradley
C. McKenzie, R.P.E. #36912. Please note the mention of this authorization
for a plan change shall be included in any future request to the Department
for Certificate of Compliance for the project.
Bob suggested that the commission go by Burnett & Granite Sts.
to observe the area. They have a building permit. The original request
for permit was for floating foundation and that was not accepted by
the Building Dept. The Building Dept. approved the slab on top of piles
and they are presently in the process of putting the piles in. Bob said
that if you go across Burnett Street where the driveway is, turn around
180 degrees and walk into the woods, there is a 5 x 5 area of hay bales,
silt fence and a pile of rocks on conservation land. Perhaps it is some
sort of filtering system to drain the area. It appears they are pumping
it out of the site to across the street and this is not on their plans.
Bob will be contacting DPW to inquire about what is going on.
Budget 1999
5. Finalizing the Fiscal year 1999 budget, the conservation had about
$17,000 remaining in the budget. After receiving the auditor's approval,
we looked for new contractors due to the fact the present contractor
was not performing. Monies have been put aside into the account for
professional services - $2,000 for completing the biological survey
of the Towners & Swains Pond area where we discussed putting markers
into the ground for specific vegetation/biological items and that survey
will probably be done by the end July or early August. Regarding the
maintenance section, there is $1100 for the trail sign creation and
installation which is still behind schedule. Aquatic control has just
completed spraying Ell Pond and Towners Pond of the first applications
of Herbicide. The Earth Moving Solutions Group is charging us approximately
$2,240 for moving the dried dehydrated water lilies on the Towners Pond
bank area. This is from last year's project as the contractor did not
get around to it and now we have another contractor who has started
it. Bartlett Consolidated has gone through the beginning of the first
section of fencing along Swains Pond - we have $9,000 put away for that.
We have $1100 for the Ell Pond Water Shed Drainage Study.
Budget/2000
6. The adopted budget for the fiscal year 2000 is for $17,555. Last
year we had a total budget of $26,775, but we had a carryover of $9,650.
Ell Pond Festival
7. Bob reported that a video of the first Ell Pond Festival held on
6/19/99 from 5-9 p.m. will be shown this week on MMTV, along with the
history of Ell Pond by Leonard Peterson.
Ell Pond Restoration Citizens' Committee
8. Correspondence from the Ell Pond Restoration Citizens' Committee
was read, informing the commission of the Lake & Pond Grant - Crystal
Street Shoreline Improvement Plan. The goal is to remove and revegetate
the degraded "5th" tennis court and the adjacent dirt parking
lot, and place a 3' wide connecting footpath within the restored landscape.
A "before" and "after" plan view of the Crystal St. green way area was
passed around. Details will follow, including the Notice of Intent to
the Conservation Commission.
Invoices Paid
9. Voted to pay the following invoices:
1. Aquatic Control $1,987 for chemical treatment of nuisance aquatic
vegetation which occurred on 6/28/99.
2. Secretary's billable hours for June 1999 - $155.00.
70 Bay State Road
10. We have a determination for applicability from 70 Bay State Road.
They want to build a deck in their backyard, but one-half of the property
is in the flood plain. Bob will ask Paul Locke to look at this and drop
off the application.
Coyotes/Middlesex Reservation
11. Correspondence from the Middlesex Reservation informed us that
trappers have gone in and observed tracks of coyotes. Four years ago
Melrose had a small population of coyotes and now they are discovering
a large population.
3 Maple Terrace - Anthony Dantona
12. Peter Mortimer reported that on 6/29 he went to 3 Maple Terrace
and spoke with Adelle Dantona, co-owner of the property, after which
he had a telephone conversation with Anthony Dantona. He then walked
the site of the wetland. It appears that it is within the 100 yd. of
the buffer zone and will come under our jurisdiction. In Section B of
WPA Form 1, the area depicted in the plans below is in the jurisdiction
Wetland Protection Act. The boundaries of Section B in this plan were
not delineated by Mr. Veneziano, but Mr. & Mrs. Dantona gave Peter
an old plan that they had from when their house was built which does
show the 100 yd. buffer zone. It has not changed. Peter visited the
wetland. The pool is still going to be 100 ft.. When you look at the
plans of the house before it was built and the plan for the proposed
swimming pool and deck, you can see the pool and deck will be within
the area of the wetland. In order to expedite matters, Peter suggested
the commission give the RDA that is within the jurisdiction of the Wetland
Protection Act (within the 100 yd. buffer zone), and accept the obligation
to move on to the next step and accept the application for the Order
of Conditions.
The area described in the plans in reference above which includes all
or part of the area as described in the request is within the area subject
to the protection under the act, therefore any removing, filling, dredging
or altering of that area requires a Notice of Intent.
Voted: A positive recommendation in the determination
of applicability for 3 Maple Terrace.
Voted: to request a complete Notice of Intent.
The applicant will submit a copy to DEP and also send us a copy.
20 Maple Terrace
13. Regarding Mr. Jeff Green's property at 20 Maple Terrace. He came
before us on 6/3/99 regarding a Request for Determination of Applicability
to pave his driveway and it was voted to grant a Negative Determination
for the work. Nancy Naslas reported that the driveway is now in place
and the site is clean. It is done as described at the meeting.
