Meeting Minutes of 5-2-02

Present:  Nancy Naslas, Paul Locke, Susan Murphy, David Valade

Voted:  To accept the minutes of 3-21-02, 4-4-02 and 4-18-02.

Voted:  To pay the secretary $198.00 for services rendered in April.

Nancy:  We have just received one resume for our secretarial position.  We ran it in the Melrose Free Press last week and will probably ask for them to run it once again.

Correspondence:

·        Urban River News

·        Mt. Hood-Arbor Notices – May 11

·        Grant Funding for Coastal Pollution Remediation Grant (which probably does not apply to Melrose)

·        Received a photocopy of an Email sent to Mayor from Kim DeLeiere to Mayor Robert Dolan: “If you do not know already there is a swan’s nest down at Ell Pond.  This is very exciting for the local community to have such a site right on the side of the Lynn Fells Parkway.  But that is my concern.  This location will become very dangerous for the ducklings, and I would like to know if there is something that can be done to redirect the young duck from such a busy street?  It would be of great interest to me, in knowing any further information or suggestions that you may have on the matter.”  Nancy will forward a note to Kim with all of the Ell Pond Restoration Committee people information.

·        We have our mosquito control project spring aerial application to control mosquito larvae in Pine Banks Park and adjacent to Towners Pond and Penny Road in accordance with their annual reports that they give us to detail their project and notification that they are going forward.

·        Notice of Public Hearing from the Board of Appeals from the City of Melrose for all parties interested for or against the appeal of Alan Crowley for a variance from the requirements of the zoning ordinance for construction of a single family  home at 16 Whitwell St., Melrose.  We must have abutting property.  The Building Dept. always refers people to us if there are any wetland or water issues.

·        The Board of Appeals, as a result of a public hearing, voted to grant the appeal of Daniel Zarella to construct a front porch on the property located at 120 Bay State Road, Melrose.

·        The Board of Appeals will hold a public hearing on May 8 for all parties interested for or against the appeal of Michael Coleman and Jessica Mitchell for a proposed two-story addition to a single-family home on the property at 181 Beech Ave., Melrose.

·        Board of Appeals public hearing on May 8 for or against the appeal of Anthony and Christine Mele for a variance from the requirements for the reconstruction and enlargement of an existing attached porch at 22 Belmont Place, Melrose.

Nancy:  We have done the Melrose Free Press notifications for our two Notice of Intent meetings that we have scheduled for next Tuesday which we will hold jointly with the Malden Conservation Commission at City Hall at 7 p.m.  Both applicants have submitted their fees now and have submitted their final NOI’s.  I have copies here for everyone to look at and the site visit.  We have received copies of the notice from the Malden Conservation Commission for both of the hearings.

Paul:  Saturday morning seems like the best time at 8 a.m. for us to meet at the parking lot of City Hall and then go to both sites.  I will inform those who are not present tonight.

 

26 Standish Rd.

Nancy:  I have received phone calls, one from Mr. Joe Turner, who is interested in the lot for his aunt at 26 Standish Rd., which I believe is on the Stoneham line, and he was wondering if he would need to come before us for anything regarding that property.  I am not familiar with the area.  I don’t know why he was supposed to talk to us.  Maybe he was curious because it abuts conservation land.  Would you follow up on that, Susan, and I will Email you his phone number?

Susan: Yes, Standish Rd. is between West Emerson and Wyoming towards the Lynn Fells Parkway there.  It is sort of high up on the hill.

Paul:  It is up above Conant Park.  If you are in Conant Park and looking at the baseball field where the refreshment stand is, it is up above that.

Nancy:  We need to make sure we know which one 54 is, because there is that wetland next to Conant Park where Spot Pond Brook goes through there as well. 

 

76 Bay State Road/Fimiani

Nancy:  I received a call from the Melrose Free Press regarding Mr. Fimiani, 76 Bay State Road.  We did the Request for Determination last January.  Well, he didn’t pay his bill, so they are going to write it off which means they won’t ever run an ad for him again.  He would have to prepay.  I left him a message and he hasn’t called me back.

Lynn Fells Parkway/Dunkin Donuts

I got a call from a gentleman regarding flood plain and did they need insurance at the new Dunkin Donuts on the Lynn Fells Parkway?  He wondered what the flood elevations were.  Did you know they might have found gasoline floating on top of the wells over there, which wouldn’t be a good thing?  There doesn’t seem like anything is being done about it at the moment.

David V.:  Considering there are two gas stations and another that was there in that area.

Nancy:  I need to look in the files to recall what we decided regarding Dunkin Donuts on this, how we resolved that.

Paul:  Well, they were keeping the same elevation.  They did an NOI.

Nancy:  Just so you know, I will be looking into that in the files. 

 

Conant Park/Drums

Nancy:  Just so you know last Monday I went out and took samples next to the drums at Conant Park with Ed Kelly from Emergency Management, with free supplies from Luke Fabbri, who owns the environmental consulting firm down on Tremont St.  I asked him I could borrow a PID, and he gave me a cooler full of the supplies I needed, which was very nice.   We are just waiting for the results on that.  I ended up submitting to TPH modified 8100 samples to see if there is something there or not.  It didn’t smell like anything  It seems like the drums have been there for 30 years, and come to find out from Mr. Kelly that there may be more drums just around the hill from there too, similar situation, similar conditions.  As soon as we get the results, hopefully we will have them take them out.

 

Penny Way

David V.:  I at least got to the point where I confirmed who the owner is and who the contact is.  I haven’t done that yet.

Nancy:  They needed to notify us before they started work.

David V.:  As far as I am concerned it is all jurisdictional, because it was one lot that the OOC was placed on. 

Nancy:  They have definitely done work there.

David V.:  They have one lot that is listed as sold.    Also, you might have noticed just 100 yds. after you come up Swains Pond Ave. on to Penny Road, someone flagged a lot there.  It is flagged for construction or something.  It is across the street from the wetland and it is definitely in the buffer zone. If anyone is doing anything there, a good half or 1/3 of the lot is going to be in the buffer zone.

Nancy:  We should all each take a day to drive by so everybody checks it.

David V.:  We will also probably hear from George Laskey who comes from Malden if they do something.  If you are by the Building Dept. or if you see them you might let them know if they are looking at permits.  It might be just flagged to sell or something, I don’t know.

8 Hemenway/Amero

Nancy:  Mr. Gregorio in the Building Dept. is very good about sending people our way.  As a matter of fact, Mr. Amero from Hemingway called me regarding Mr. Gregorio wouldn’t give him his occupancy permit.  At 8 Hemenway they have completely returned the site to the requested condition when they submitted their NOI.  It looks so much better.  Mrs. Rose, next door, has done all this beautiful landscaping right in front.  You can see the old wall now, and you can see the new wall set back the way it was supposed to be, and then on the Malden side of the property, that is terraced the way it was supposed to be.  It looks really nice. 

 

5 Hemenway

Nancy:  I went to the site visit for the pool.  I went and inspected the erosion control after they were put in place before they were doing the pool construction at 5 Hemenway.

David V.: Why hasn’t he given him his Certificate of Occupancy?

Nancy:  He has.  We would have come here tonight to talk about it, but then he called me to say he won’t be coming.  He did get it.

Paul:  I went over and looked.  He did a great job.
